We operate the KikAssist web application available at kikassist.com (the "Web App"), the KikAssist mobile application (the "App"), and any other related products and services that refer or link to these legal terms (collectively, the "Services").
KikAssist is a football/soccer-themed word puzzle game featuring Kikky, the Soccer Brain-3000. Earn Kik Credits by solving puzzles and completing daily challenges.

BY ACCESSING THE SERVICES, YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY ALL OF THESE LEGAL TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
All users who are minors in the jurisdiction in which they reside must have the permission of, and be directly supervised by, their parent or guardian to use the Services.
The Services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information promptly.
1. OUR SERVICES
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.
2. INTELLECTUAL PROPERTY RIGHTS
We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services, as well as the trademarks, service marks, and logos contained therein.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Services through automated or non-human means; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use of the Services will not violate any applicable law or regulation.
4. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the Services available. You agree not to systematically retrieve data from the Services, make any unauthorized use of the Services, circumvent security features, or use the Services to advertise or offer to sell goods and services.
5. USER GENERATED CONTRIBUTIONS
The Services may invite you to contribute to forums, message boards, and other functionality. Any content you submit must not violate these Legal Terms or any applicable law.
6. CONTRIBUTION LICENSE
By posting Contributions to the Services, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide license to host, use, copy, reproduce, disclose, sell, publish, and distribute such Contributions.
7. PURCHASES AND REFUND POLICY
General: Hint packs are available for purchase through the KikAssist web application at kikassist.com (processed via Stripe) and through the KikAssist mobile application on the Apple App Store (processed by Apple Inc.) and Google Play Store (processed by Google LLC). All hint packs are consumable products: once a hint is used in gameplay, it cannot be restored, returned, or refunded.
Mobile App Purchases (Apple App Store and Google Play Store): If you purchase a hint pack through the KikAssist mobile application, the refund policy of the applicable app distributor (Apple or Google) governs that purchase. Please refer to their respective policies for details. Olipop Software and Design LLC does not process refunds for mobile app purchases directly.
Restore Purchases (Mobile): The KikAssist mobile application provides a "Restore Purchases" function as required by Apple and Google. Because hint packs are consumable products, this function is intended to recover any purchase that was paid for but not successfully delivered to your account due to interruption (such as a network failure during the transaction). Hints that have already been credited to your account and used in gameplay cannot be restored, as they have been consumed by design.
Balance Adjustments After Refund: If Apple or Google refunds a mobile in-app purchase, we will receive a notification from the platform and will deduct the corresponding number of hints from your hint balance. If your hint balance is lower than the refunded quantity at the time the refund is processed, your balance will be reduced to zero; we do not maintain negative balances. We reserve the right to restrict future in-app purchases for accounts that exhibit patterns of refund abuse or fraudulent activity, in accordance with Apple's and Google's policies.
No Subscriptions: All in-app purchases offered by KikAssist are one-time consumable purchases. KikAssist does not offer auto-renewing subscriptions or recurring charges of any kind through its mobile application or web application.
Web Application Purchases (kikassist.com only): The following terms apply solely to hint pack purchases made on kikassist.com.
(a) All Sales Final: All purchases of hint packs on kikassist.com are final and non-refundable, except as expressly set forth in this Section 7 or as required by applicable law.
(b) Service Disruption Refund: If a verified service outage caused solely by Olipop Software and Design LLC prevents you from accessing the KikAssist web application for a continuous period of 48 hours or more, and you have an unused purchased hint balance at the time of the outage, you may be eligible for a pro-rata refund of your unused purchased hints. To request a refund under this provision, you must contact us at info@olipopsoftware.com within 30 days of the disruption with your purchase details. We reserve the right to verify the outage and the extent of impact before issuing any refund. Refunds under this provision will be issued via the original payment method where possible.
(c) Account Deletion: If you voluntarily delete your account, any unused purchased hint balance associated with that account is forfeited. No refund will be issued for unused purchased hints upon voluntary account deletion.
(d) Inactivity: Unused purchased hints do not expire due to inactivity. No refund will be issued solely because you have not played the game or used your purchased hints for any period of time.
(e) Used Hints: Once a purchased hint has been consumed in gameplay, it cannot be refunded under any circumstances.
(f) Earned Credits: Credits earned through gameplay (puzzle completion and daily streaks) have no monetary value and are not refundable under any circumstances.
(g) Payment Processing: Payments on kikassist.com are processed by Stripe, Inc. By making a purchase on kikassist.com, you also agree to Stripe's terms of service. Payment disputes for web purchases should be initiated through Stripe's dispute process. For mobile purchases, disputes should be directed to Apple or Google per their respective policies.
8. SOFTWARE
We may include software for use in connection with our Services. If such software is accompanied by an end user license agreement, the terms of that agreement will govern your use of the software.
9. PROHIBITED USES OF SERVICES
In addition to other prohibitions set forth in these Terms, you are prohibited from using the Services for any unlawful purpose, to violate any regulations, or to interfere with the proper working of the Services.
The following additional prohibitions apply to the multiplayer feature:
- Using offensive, vulgar, discriminatory, or misleading display names
- Exploiting bugs, glitches, or vulnerabilities in the multiplayer system to gain an unfair advantage
- Using automated tools, bots, scripts, or any form of software automation to play multiplayer games
- Intentionally disrupting, interfering with, or degrading the multiplayer experience for other players
- Colluding with other players to manipulate scores, rankings, or game outcomes
- Creating multiple accounts to gain an unfair advantage in multiplayer sessions
We reserve the right to terminate any multiplayer session, suspend your access to the multiplayer feature, or take other appropriate action if we determine, in our sole discretion, that you have violated any of these rules. Repeated violations may result in permanent suspension from the multiplayer feature or termination of your account.
10. DISCLAIMER
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF.
11. LIMITATIONS OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY TO YOU WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
12. USE LICENSE
Permission is granted to temporarily download one copy of the materials on KikAssist's application for personal, non-commercial transitory viewing only.
13. ACCURACY OF MATERIALS
The materials appearing in the Services could include technical, typographical, or photographic errors. We do not warrant that any of the materials are accurate, complete, or current.
14. LINKS
We have not reviewed all of the sites linked to our Services and are not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by us.
15. MODIFICATIONS
We may revise these Terms of Service at any time without notice. By using the Services, you agree to be bound by the then-current version of these Terms of Service.
16. GOVERNING LAW
These Legal Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
17. PRIVACY POLICY
Please review our Privacy Policy at www.kikassist.com/privacy.html. By using the Services, you agree to be bound by our Privacy Policy. You may request deletion of your personal data by contacting us at info@olipopsoftware.com.
By participating in multiplayer sessions, you acknowledge and agree that certain information — including your display name, avatar, scores, and game results — will be visible to other players in your session and stored as part of multiplayer achievement records. For more information about how we handle your data, please refer to our Privacy Policy.
18. TERM AND TERMINATION
These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to deny access to and use of the Services to any person for any reason.
19. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We also reserve the right to modify or discontinue all or part of the Services without notice.
20. CORRECTIONS
There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors at any time without prior notice.
21. DISPUTE RESOLUTION
The Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.
If any provision of this arbitration agreement is found unenforceable, that provision shall be severed, and the remainder of this arbitration agreement shall be given full force and effect.
22. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, to the extent permitted by applicable law, made by any third party due to or arising out of your use of the Services.
23. USER DATA
We will maintain certain data that you transmit to the Services for the purpose of managing performance. Although we perform regular backups, you are solely responsible for all data that you transmit.
24. ELECTRONIC COMMUNICATIONS
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications.
25. CALIFORNIA USERS AND RESIDENTS
If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834.
26. VIRTUAL GOODS AND IN-APP CURRENCY
The Services include virtual goods and in-game currency, specifically: (a) Credits (referred to as "Assists" within the KikAssist mobile application) — earned through gameplay activities including puzzle completion, daily streaks, and ad-based rewards in the mobile application; and (b) Purchased Hints — acquired through paid transactions on kikassist.com (processed via Stripe) or through the KikAssist mobile application on the Apple App Store (processed by Apple) and Google Play Store (processed by Google). These are maintained as two separate balances.
Hint Deduction Order: When a player uses a hint, Purchased Hints are deducted first. If the Purchased Hints balance is zero, Credits (or Assists, in the mobile application) are deducted at a rate of 500 Credits/Assists per hint. This deduction order is automatic and non-negotiable.
Free Hints: The KikAssist mobile application includes one free hint granted upon starting a game session. This free hint has no monetary value and is not refundable or transferable.
No Expiration of Purchased Hints: Purchased Hints do not expire. They remain available in your account until consumed in gameplay or until the account is deleted.
Credits and Assists have no real-world monetary value and cannot be exchanged for cash, gift cards, or any other form of legal tender. Credits and Assists are non-transferable and non-refundable under any circumstances. We reserve the right to modify, manage, regulate, control, or eliminate Credits and Assists at any time, with or without notice.
Purchased Hints have no real-world monetary value outside of their use within the Services and cannot be exchanged for cash, gift cards, or any other form of legal tender. Purchased Hints are non-transferable. Refunds for Purchased Hints are governed exclusively by Section 7 of these Legal Terms.
Your purchase or earning of virtual goods grants you only a limited, non-transferable, revocable license to use such virtual goods within the Services, and you acknowledge that you have no ownership interest in any virtual goods or currency.
27. FORCE MAJEURE
We shall not be liable for any failure or delay in performing our obligations under these Legal Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, strikes, government actions, failure of third-party telecommunications or power supply, or cyberattacks.
28. STRIPE PAYMENTS AND PAYMENT DISPUTES
Payments made on kikassist.com are processed by Stripe, Inc., a third-party payment processor. By completing a purchase on kikassist.com, you agree to Stripe's Terms of Service (available at stripe.com/legal) and Privacy Policy (available at stripe.com/privacy). Olipop Software and Design LLC is not responsible for any errors, failures, or unauthorized transactions that occur at the payment processor level. All payment disputes must be initiated through Stripe's dispute resolution process. Our refund policy, as set forth in Section 7, governs eligibility for refunds independently of any payment dispute outcome.
Multiplayer sessions may include players across different platforms (Android, iOS, and web). While we strive to provide a consistent experience, gameplay may vary slightly between platforms. We do not guarantee feature parity across all platforms at any given time and are not liable for any differences in gameplay experience between platforms.
We reserve the right to remove, modify, or restrict any public session or display name that we determine, in our sole discretion, to be inappropriate, offensive, misleading, or in violation of these Terms. We are not obligated to monitor public sessions but may do so at our discretion.
The multiplayer feature allows you to create public waiting rooms visible to all users. When you create a public session, your display name and session details are visible to other users. You are solely responsible for the content of your display name.

These Legal Terms and any policies posted by us on the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver of such right or provision.

33. THIRD-PARTY CONTENT AND DATA SOURCES
The Services display content sourced from the following third-party providers:
(a) Wikipedia / Wikimedia Foundation. KikAssist displays player information sourced from Wikipedia via the Wikimedia REST API. Wikipedia content is licensed under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0). By accessing player information within the Services, you acknowledge that such content is provided by Wikipedia contributors and is subject to its applicable license. Attribution is displayed within the Services where player information appears. KikAssist and Olipop Software and Design LLC are not affiliated with or endorsed by the Wikimedia Foundation. For more information about Wikipedia's license, visit creativecommons.org/licenses/by-sa/4.0.
(b) No User Data Transmitted. Our use of the Wikimedia API does not involve the transmission of any personal user data to the Wikimedia Foundation.
